EYOLF Inc. (“us”, “we”, or “our”) designs and manufactures professional climbing, rope access, rope rescue, arborist, and adventure park equipment from our facility in Fergus, Ontario, Canada. The following terms describe our product warranty, our returns policy, and the conditions under which we supply equipment to our customers and resellers.
Equipment offered by EYOLF Inc. is warranted against factory defects in workmanship and materials for a period of three years from the date of installation or first use by the owner, provided that this period shall not exceed three years from the date of manufacturing (see label on product).
Upon notice in writing, EYOLF Inc. will promptly repair or replace all defective items. We reserve the right to elect to have any defective item returned to our plant for inspection before making a repair or replacement.
This warranty does not cover equipment damage resulting from abuse, damage in transit, or other damage beyond our control. The warranty applies only to the original purchaser and only to EYOLF products, and is in lieu of all other warranties, expressed or implied.
To return goods, the buyer must contact us first. Returns must be authorised by EYOLF before goods are shipped back to us.
Standard goods may be returned subject to a 10% restocking fee. Returned items must be the current model and packaged in re-saleable condition.
Custom or special-ordered goods require pre-payment and cannot be cancelled or returned.
Defective or faulty goods are covered under our warranty. EYOLF will, at its option, replace, repair, or refund the purchase price of any goods proved to our reasonable satisfaction to have been delivered short or to be defective. Where goods cannot be repaired or replaced, a credit note will be issued to the original value.
All prices are quoted in Canadian dollars, excluding local sales taxes and other duties unless specifically stated otherwise. Quotations are valid for thirty (30) days or until our price list is updated. EYOLF reserves the right to amend specifications and prices as necessary, and to decline to supply.
Government orders and pre-approved orders must be confirmed with a Purchase Order. All orders ship FOB Fergus, Ontario, Canada unless otherwise stated.
Where standard EYOLF products are supplied on a pro-forma basis, those goods will be dispatched only upon receipt of cleared funds. Cash, drafts, credit-card payments and credit transfers result in immediate dispatch.
If your order is not on your shipping account, EYOLF will dispatch the order using our method and choice of carrier unless agreed otherwise prior to dispatch.
Delivery dates given by EYOLF are a genuine forecast in light of current conditions but are given without legal commitment, and EYOLF accepts no liability if it is unable to meet those dates. Non-receipt of goods for delivery must be reported to EYOLF in writing within 5 working days of placing an order for immediate delivery, or of the agreed delivery date for forward orders (within 8 days for the EU or USA).
Ownership of goods supplied remains with EYOLF until we have received cleared funds in full for the goods supplied. We reserve the right at any time to review or cancel any credit arrangements with any buyer, without notice.
We reserve the right to exercise our statutory right to claim interest and compensation for debt-recovery costs under late-payment legislation if we are not paid according to agreed credit terms.
Demonstration and loan equipment is supplied solely on the understanding that the prospective customer takes full responsibility for its use.
It is the responsibility of the buyer to ensure that all technical data and instructions provided with the product by EYOLF are supplied to the end user.
This contract is governed by Canadian and European law based on location of dispatch and is subject to the jurisdiction of the Canadian courts in Ontario or the Netherlands.
EYOLF is a registered trademark of EYOLF Inc. The buyer shall use the EYOLF name and EYOLF logo with respect.
